1. Acceptance

By using Thremark, you agree to these terms. If you do not agree, please do not use the app. You must be at least 13 years old to use Thremark.

2. The Service

Thremark is an AI assistant that knows you and remembers facts you share ("Marks"). It offers AI conversations through third-party providers (OpenAI, Google Gemini, Anthropic), including reasoning models, web search via Tavily, AI image generation via Google Gemini, real-time Voice AI via Google Gemini Live/OpenAI Realtime, voice input, and AI-generated files. AI responses may contain errors — do not rely on them for medical, legal, or financial advice.

3. Subscriptions

• Free — 1,000 messages/month · Voice AI 10 min/day · 50 marks · 10 files · 30 web searches/month · 5 images/day · standard AI routing.
• Plus ($14.99/month or $179.99/year) — 5,000 messages/month · Voice AI 90 min/day · 500 marks · 50 files · 150 web searches/month · 50 images/day · premium models · chat export.
• Pro ($29.99/month or $359.99/year) — 15,000 messages/month · Voice AI 180 min/day · unlimited marks and files · 1,000 web searches/month · 80 images/day · all AI modes including deep reasoning.
• Payment is charged to your Apple ID account upon purchase confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before renewal.
• Manage subscriptions: iOS Settings > Apple ID > Subscriptions or app Settings > Manage Subscription.
• Any unused portion of a free trial expires upon purchase of a subscription.

Subscriptions are governed by the Apple Standard EULA.

4. Acceptable Use

You agree not to use Thremark to:

• Generate illegal, harmful, or offensive content
• Attempt to bypass security filters or usage limits
• Reverse-engineer the app or its server communications
• Use the service for automated data collection

5. Your Data

You own your marks and chat history. Thremark stores data on your device and syncs it securely. See our Privacy Policy.

6. Account Deletion

You can delete your account anytime in Settings. All data (marks, files, chats, messages) is removed immediately. Some aggregated analytics data may be retained.

7. Limitation of Liability

To the maximum extent permitted by law, Thremark is provided without warranties. We are not liable for data loss, AI inaccuracies, service outages, or indirect damages.

8. Voice AI and Voice Input

Voice AI sessions stream audio to Google Gemini Live API or OpenAI Realtime API. AI can automatically extract facts (marks) and create files. Audio is not stored after the session.

Voice input (push-to-talk) uses speech-to-text transcription via our proxy server. Audio is not stored after transcription.

9. Files

Thremark can create files from long AI responses or on request. Files are stored on your device and synced across devices. You can view, rename, share, and delete them anytime.

10. GitHub Sync

With GitHub Sync (Plus/Pro), Thremark creates a private repository in your GitHub account with marks, files, and chat history in markdown. Your GitHub OAuth token is stored encrypted. You can disconnect anytime in Settings.

11. Referral Program

You can invite others with a unique code. Successful referrals may grant temporary subscription benefits to both parties. Rewards may be changed or discontinued anytime.

12. Intellectual Property

You retain ownership of marks, files, and chat messages. AI-generated responses are provided for personal use. Thremark's name, logo, and interface are the property of Thremark.

13. Termination

We may suspend or terminate access upon violation of these terms. You can stop using Thremark and delete all data in Settings anytime.

14. Governing Law

These terms are governed by applicable law. Disputes will be resolved through good-faith negotiation before formal proceedings.

15. Changes

We may update these terms as new features are released. Continued use after changes constitutes acceptance.

16. Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.
